Terms of service
What we agree to do, what you agree to do, and the limits on both.
Last reviewed
Not yet reviewed by counsel. This is placeholder wording. It has not been reviewed by an attorney and is not the agreement that will govern your use of the product. Final terms will be published before launch.
What diyre is
diyre is a guided flat-fee home-selling platform. We provide software, coordination tools and access to licensed professionals. Where a listing is placed on a multiple listing service, that placement is made through a licensed brokerage, and the brokerage relationship is described in your listing agreement rather than here.
We are not your attorney, your accountant or your appraiser. We do not guarantee that your home will sell, when it will sell, or for how much.
What you are responsible for
The information you enter about your property is a set of representations you are making to buyers. We check it for completeness and for known requirements, and we tell you when something looks wrong, but we cannot verify facts only you know.
- Answering accurately, including about known defects and material facts.
- Deciding your list price. Our estimate is an estimate and never an appraisal.
- Deciding who enters your home and on what terms.
- Reading anything you sign, and getting advice on anything you do not understand.
Money
You pay one flat fee for the package you choose, plus any optional services you add. We do not take a percentage of your sale price.
We never hold your earnest money, your deposit or your sale proceeds. Those are held by a licensed third party, a title company, escrow agent or attorney, named in your contract. Anyone telling you to send funds to diyre is attempting fraud.
diyre is the licensed brokerage for every agent
Every real estate agent offering licensed services on diyre does so as an independent contractor under the diyre brokerage, which is their broker of record and supervises their licensed work. There is no option on diyre to work under another brokerage.
When you book licensed real estate work, such as a showing, a tour, an MLS entry, a pricing analysis or negotiation help, you are contracting with the diyre brokerage, and the agent who does the work is acting for it.
How agents are paid
For licensed real estate work, you pay the price shown to the diyre brokerage. Nothing is added to it for the brokerage's share.
Once you accept the work and a short hold period has passed, the diyre brokerage schedules the agent's payout: 95% of the order goes to the agent's own account, and the brokerage keeps 5%. Card processing costs are paid by diyre and are not taken from the agent's share or added to your total.
Professionals offering services that need no real estate licence, such as photography, staging or cleaning, are paid directly. Settlement services, such as title, escrow, mortgage, appraisal, inspection and legal work, are never paid through diyre and diyre takes nothing from them.
If a job is cancelled, disputed or refunded, the payout waits until it is resolved, and any refund comes back to you through the same payment method.
Requests, tours and offers from professionals
When you ask a professional for a service and say where the work is, your request also goes to the other verified professionals who offer that service there, so you can compare offers. Nothing is booked until you accept an offer.
An agent can plan a tour of homes for you and invite you to it. You can accept, decline, ask for another time, react to and rate each home, suggest homes, bring someone along, and message the agent. Showings at homes listed on diyre are asked of their sellers; showings at other homes are arranged through our team or by the agent.
When the professional marks the work done, you can accept it or report a problem. If you do neither within seven days, the work counts as accepted. A problem you report holds the payment while a person at diyre looks at it.
Ratings, reviews and replies
Customers can rate and review the professionals they hired; those reviews are public, with the customer's first name, and the professional can reply publicly, once. Visitors can rate the homes they toured; a home rating goes only to its seller, and only when the visitor chooses to share it, and the seller can reply once, to that visitor only. Reviews are not removed for being unfavourable; they can be hidden only for breaking our content rules, such as revealing personal information or discriminating against anyone.
Ending the agreement
You can stop using the platform at any time. A listing that has been published to an MLS is governed by the listing agreement you signed with the brokerage, which sets out how and when it can be withdrawn.
